Lawyers of Exiora Law Firm Win in the Supreme Court of Russia

On April 4, 2016 the Economic Panel with the Supreme Court of Russia reversed judgments issued in the dispute between Metalloinvest LLC and VEB-Leasing concerning repayment of monies remitted under leasing contracts.

When considering this case as a separate dispute in the bankruptcy case of Metalloinvest LLC, the Moscow City Arbitration Court in a court hearing declared the operative part of its judgment pursuant to which the claim for repayment of payments made under leasing contracts was partially satisfied. However, subsequently in the court’s electronic records the operative part of the judgment was published according to which the claim was dismissed. The Ninth Arbitration Court of Appeals and the Moscow Region Commercial Arbitration Court upheld the first instance.

In the Supreme Court hearing, the client was represented by Yuriy Sbitnev, Partner, Exiora Law Firm. Upon the results of considering the cassation appeal, the previously issued judgments were reserved and the case remanded to the Moscow City Arbitration Court.
