Lawyers of Exiora recovered from the former Director 77 million rubles of losses in case of bankruptcy of “Inzhgazstroy” LLC

In the bankruptcy of the General contractor, “Inzhgazstroy” LLC (case number A40-48876/2015), which carried out the construction of a plant for production of titanium coagulant in the Komi Republic, the legal team of Exiora revealed transactions aimed at the conclusion of the debtor’s assets by the former General Director. The amount of losses amounted to more than 280 million rubles. In order to create a prejudice, a claim for 77 million rubles was initiated for the recovery of losses, the validity of which was not in doubt.

The ruling of the court of first instance, left unchanged by the court of appeal, the claim was denied.

The court of cassation, granted our complaint and returned the case for a new trial.

On the second lap lawyers of Exiora managed to achieve satisfaction of requirements about collecting of losses from the former Director General in full.

Higher courts upheld the court’s decision.
